On Aug. 9, London Wallace will finally get his day in federal court, where he has accused the Fresno Police Department of violating his civil rights. Senior U.S. District Court Judge Anthony W. Ishii ruled this month that Wallace has a legitimate civil rights lawsuit against Officers Christopher Martinez, Ricardo Loza and Patrick Feller for excessive force, false imprisonment and intentional infliction of emotional distress. Ishii also ruled that the officers could be on the hook for punitive damages because the beating of Wallace could be viewed by the jury as “reckless disregard” for his civil rights.
In his June 10 ruling, Ishi said Wallace complied with police commands, was not a threat to them and was not actively resisting. He also ruled that police repeatedly punched Wallace without provocation and while the teen was pinned on the ground.
