Plaintiff, Nicholas Merlo, age 39, was being transported by American Ambulance from a surgery center, where he underwent an upper endoscopy procedure, to the hospital when he was extubated in the ambulance by the paramedics. After extubating Mr. Merlo in the ambulance en route to the hospital, the paramedics attempted multiple times to reintubate Mr. Merlo in the back of the moving ambulance, but were unsuccessful. Mr. Merlo’s oxygen saturation continued to drop. When he arrived at the hospital, Mr. Merlo had pulseless electrical activity and was in cardiac arrest. The emergency room physician was able to successfully intubate Mr. Merlo, but the damage was already done and Mr. Merlo was in a permanent vegetative state due to anoxia (being without oxygen). Mr. Merlo remains in a persistent vegetative state and will remain in that condition for the rest of his life. At the time, Mr. Merlo’s wife, Plaintiff, Kaci Merlo, was eight and one-half months pregnant with the couple’s first child. Mrs. Merlo also alleged her own loss of consortium claim. The Jury’s Verdict compensated the Merlos $19.8 Million for their Economic Damages and $30 Million for their Non-Economic Damages.
